Elon Musk’s Legal Battle with OpenAI: Allegations of Breached Agreements and AGI Claims
On Monday, Elon Musk took to X to express his frustration with his former company, OpenAI, and two of its executives, Sam Altman and Greg Brockman. The crux of the legal case revolves around a controversial technical assertion: that OpenAI has achieved artificial general intelligence (AGI), a concept typically associated with machines capable of comprehensively matching or surpassing human intelligence.
Alleged Breach of the Founding Agreement
Musk’s lawsuit contends that Altman and Brockman have violated the original “Founding Agreement” for OpenAI, which was established with Musk’s involvement. The agreement allegedly committed the company to develop AGI in an open manner and “for the benefit of humanity.” The suit claims that the executives have disregarded this commitment and instead pursued a path that prioritizes their personal financial gain.
The Debate Surrounding GPT-4 and AGI
Central to the lawsuit is the claim that “GPT-4 is an AGI algorithm.” GPT-4 is the large language model that powers OpenAI’s ChatGPT. The suit points to studies demonstrating the system’s ability to pass the Uniform Bar Exam and other standardized tests as evidence that it has surpassed certain fundamental human capabilities.
“GPT-4 is not just capable of reasoning. It is better at reasoning than average humans,” the suit claims.
However, despite the impressive performance of GPT-4, the majority of AI experts do not consider it as definitive proof of AGI. As Anthropic CEO Dario Amodei states, “GPT-4 is general, but it’s obviously not AGI in the way that people typically use the term.” Amodei further highlights that many corporations are actively working on developing AGI.
Skepticism Surrounding the Merits of the Case
Samuel Brunson, an associate dean at Loyola University Chicago who specializes in nonprofit law, expresses doubts about the case’s merits and chances of success. Brunson points out that Musk’s primary argument is that OpenAI’s pursuit of profits and collaboration with for-profit entities has caused it to lose its nonprofit status, which he considers to be incorrect.
